    Dear Mr. McFeely,

    The residents of Priory Hall who have been evacuated from their homes and have no indication as to when or if they will ever return to their homes due to your negligence and the negligence of sub contractors employed by you request that you:-

    1. now admit that you have further means than those contained in your sworn Affidavit of Means to the High Court, a number of which we are aware of including a lucrative hotel business in the Algarve, Portugal;

    2. step up and do the honourable thing and provide the homes we paid for at an average rate of €300,000 per unit, funds which you have had the benefit of since 2007 and have not carried out the required works to provide us with safe homes for our children.

    Your negligence and lack of conscience has left us without homes and we will not rest until we have safe homes for our families, the homes we bought and paid for. We will not go away Mr. McFeely and you can count on us to face you at every Court hearing no matter how long it takes you have taken our homes from us and anger is our motivation. You may think you can continue to ignore us or avoid eye contact with us when our paths cross but ours is a fight for what is rightfully ours and we will be tenacious in the extreme until we reach our goal.

    We do not wish you a Happy New Year as you have ruined the last 4 years of our lives, we do however wish that you find it in your conscience to find a workable solution to the problems in Priory Hall and stop using the “I’m broke” defence it’s not credible and we know Martin Hayden SC doesn’t come cheap or work on the free legal aid panel so prioritise who should be paid first the homeless residents of Priory Hall or your legal representatives.

    DCC denies that it offered residents 50k each for their properties in December:
    The statement comes after homeowners from Priory Hall claimed the offer was made to their legal representative in early December.
    Residents' spokesperson Graham Usher said the offer was made but in any event it is not acceptable to owners as most have outstanding mortgages of up to €350,000.
    He said selling for €50,000 would leave them to shoulder massive personal debt.
    Meanwhile the council is continuing to pay the accommodation cost of Priory Hall residents put out of their home.
    However the council will go to the Supreme Court on 19 January to seek to have a High Court order that they continue to pay for the accommodation quashed.

    A snippet from BBC NI today about an McFeely company in Belfast which went into administration last week.
    Inis Developments last filed accounts for the year ending September 2010 when it showed an annual loss of £891,000.
    The company owed its banks just under £50m - most of that is understood to be owed to Bank of Ireland.
    A note in the accounts said the firm was continuing to develop a site at Stratford in east London.
    However this development is understood to have been repossessed by the Irish government's National Assets Management Agency (Nama) in November.
    The accounts also show that two other members of the McFeely family, Conal and Gerard, were co-signatories along with Tom McFeely on personal loan guarantees of £42m.
    Inis was placed into administration by Nama, acting through Bank of Ireland.

    €50,000 is presumably what they are worth, allowing for their current market value (in so far as they have one) minus the costs of bringing them to standard.

    But compared to what they paid off the places and the current going value for houses, its awful. One bed apartments in Dublin cost of minimum of at least €90k, have not seen much else for less unless its a kip in need of repair!

    Concerns over fire safety at Dublin’s Belmayne housing development is
    “not a similar situation to Priory Hall”,
    the Minister for the Environment has insisted. Deputy Phil Hogan explained that problems uncovered at the Belmayne development in relation to fire safety in January of this year were not deemed to require an evacuation – as had been necessary at the Priory Hall complex. Source

    Is this the same Phil 'Screw' Hogan that refused to meet residents on known problems at Priory Hall? Is his latest comment based on meetings with Belmayne residents

    Hard to see what is going on here - is there a good reason why DCC did not contest this Appeal? Would it have involved detailed examination in their own role in the supervision of planning and construction processes?

    Grubby deal leaves a bad taste - McDowell


    Brian McDowell, has today slammed the decision of Dublin City Council not to contest the Circuit Court appeal lodged by bankrupt developer Larry O ‘Mahoney against the district court conviction for fire safety breaches at Priory Hall.


    He said: “In a week when the Mahon report has disclosed so much about corruption in Irish politics and the link between Fianna Fail and developers it is important that the political system sends out the correct signals and deals with things openly and transparently”

    .

    “The idea that Dublin City Council did not contest the appeal on the grounds that Mr O ‘Mahony subsequently withdraws his Supreme Court appeal against the high court ruling that he was involved in Coalport, the company that built Priory Hall leaves a bad taste in my mouth.
    “Dublin City Council are going to the Supreme Court on the 24th April to try and overturn a decision of the high court that they are liable for the accommodation costs for the priory hall residents. You can be sure that the Council will turn up for this appeal and put their best foot forward in an attempt to save themselves money never mind the consequences for the residents of Priory Hall.


    "I will be asking John Tierney, Dublin City Manager to make a statement on this matter and if I am not satisfied with his answer I will table an emergency motion at the next City Council meeting looking for an explanation from the law agent on why this grubby deal was done. Answers are needed and they are needed now".

    Quick question that the brain has been pondering. Could we get a list of all estates from the councils under FOI?Maybe whack a request to the Dept of Envionment?..

    I assume the developer was also the contractor in this case. I would like to know if he directed the architect and contractor to build in a substandard way. I find it hard to see why all the focus is on him.

    We urgently need a proper system of public inspection, as takes place in other countries.
