True and worth bearing in mind.

Or indeed on the initial matter of apparently misleading the Revenue in a much broader manner than leaving accounts off a list - when first asked for a list of Non-res. account holders, the bank baldly replied that they hadn't any.

    Seanie wants an oul break

Bernard Condon SC, defending FitzPatrick, told the court he was “concerned” about the trial date in October this year because of its proximity to the trial of the former officials.

Mr Condon submitted to Judge Martin Nolan in Dublin Circuit Criminal Court that “a cascade of sludge” was visited on the head of Mr FitzPatrick (66) during that trial.

Should Justice MacCartan not have kept his eye on this potential problem ?

We were told that the Anglo investigation was taking years to complete precisely because it was a requirement to bring together all evidence, to be dealt with at the same time, because of the risk of problems of this kind.

I don't think McCartan could do much about it. He can only deal with what's put in front of him. I'm sure the DPP could have anticipated the issues that would arise regarding Fitzpatrick though.

Bernard Daly has been refused bail while waiting for his appeal to be heard. Interestingly enough the judge complained that the trial transcript wasn't available. Wonder how long it normally takes to produce transcripts?

That was the two men. What about Aoife McGuire ? Personally I couldn't see why she was prosecuted. Is she already out ?

And no statute of limitations for the Revenue ?

The whole thing was a farce.

This Irish Times article, while critical of the state for taking the case in the first place, again mentions that Anglo initially misled the Revenue (whether accidentally or otherwise):

“We have inflated the balance sheet by too much. Doing the deal with the Central Bank has inflated the balance sheet by too much,” Mr McArdle continued on the tape.

“As I said, I was talking to Con and I said look, ‘we have never managed our balance sheet’ and he said ‘oh, come on lads’, so I said ‘we have never managed it like this’.”
