    Default Pregnant woman refused abortion gives birth by Caesarean

    A woman has been refused an abortion under the country’s new abortion laws.

    The baby was subsequently delivered by Caesarean section.

    The woman was in the second trimester of the pregnancy when the baby was born.

    She sought an abortion under the Protection of Life During Pregnancy Act, 2013 as she claimed to be suicidal.

    It is believed to be one of the first cases where the new legislation was used.

    The panel of experts determined the life of the mother and the child was not at risk from suicide. However, because the pregnancy was so far advanced a decision was made to deliver the baby.

    The woman became deeply distressed after the refusal and the baby was delivered by caesarean.

    The suicide clause of the law – section 9 of the act – was one of the most contentious parts of the legislation.

    Due to the 1992 X case, there is no time limit in the 2013 act as to when a pregnancy can be brought to an end.

    But there is no obstacle in the act to prevent doctors from delivering a baby where the pregnancy is viable.

    25 weeks is not ideal though. If that child could have been given till 28, it would have been so much better for it.

    The information on this is very sketchy still, but my initial impression is of forced, compulsory birth. A terrible prospect. A terrible law. I am glad both are alive, but 'well'? that remains to be seen. I wish them both well.

    Yes, even earlier too... generally they try as hard as possible to not deliver before 25 weeks.

    Before 24 weeks tends to result in either fatality or handicap, often serious. After 28 weeks can usually be handled reasonably easily by the NICU

    We need the full story... this drip feeding of information and the inevitable speculation helps no one - including the rape victim herself

    The other reports say she requested it "late in her second trimester". The applications to court regarding hydrating the woman after her hunger/thirst strike would have happened very rapidly after she started it, so if she commenced it immediately after she was denied the abortion and the baby was delivered before a subsequent hearing (which would have not been very long after the first, a matter of days I'd imagine) any delay could not have been a very long one?

    The stories tomorrow should tell us more. In any case, dreadful stuff.

    If there is truth to the ST headline, that is exactly what they did. They delayed while termination was possible and then performed the Caesarean at the lowest limit of viability.
