    Poor old Michael couldn't possibly get a fair trial. He is much sinned against.

    The 60-year-old Tipperary TD from Holycross faces four counts of knowingly filing incorrect tax returns relating to dates in 2002, 2003 and 2007.Nenagh Circuit Court, sitting in Clonmel, is hearing an application by his defence team to have the case struck out or a permanent stay put on the proceedings.
    Mr Patrick Treacy, senior counsel for Mr Lowry, told the court this morning that the entire case was devoid of integrity.
    The court heard that Mr Lowry now faces a fifth charge, which the accused became aware of last Friday.
    This charge by the Revenue Commissioners relates to an alleged breach of the Companies Act 1990, regarding the proper keeping of accounts.
    Why is Gerry Ryan being dragged into it? How did Lowry's solicitor get hold of a letter that was written to the PAC?

    A letter from civil servant whistleblower Gerry Ryan, written to the Public Accounts Committee, was read out in court earlier by Mr Lowry's defence counsel.The letter was read out as part of the efforts by Mr Lowry's legal team to have criminal charges against him dismissed.
    Mr Patrick Treacy SC for Mr Lowry said the letter showed the differences in how the Revenue Commissioners dealt with allegations against Mr Lowry compared to others.
    So Elaine Byrne, Dermot Wilson and Anne Harris are all to blame?

    He also said that the Director of Public Prosecutions, the Criminal Assets Bureau and the Revenue Commissioners were misled by a number of parties in that there was a selective releasing of documents.He added there had been a misleading case against his client which involved Kevin Phelan, Senator Dermot Wilson, a journalist for the Sunday Independent, Dr Elaine Byrne, and the newspaper's editor Anne Harris.
    Mr Treacy said that if the case is struck out, a file should be sent to the DPP regarding various matters.
    He said that Dr Byrne did not disclose to CAB a letter from Mr Phelan to Ms Harris in which he stated he could not stand over a supposed tape recording of Mr Lowry.
    He said selective information had been released to the Sunday Independent; and that this led people taking unto themselves the administration of justice, which is the right of the courts.
    None of the people against whom Mr Lowry's counsel has made accusations were represented in court.
    The hearing before Judge Thomas Teehan continues this afternoon.

    More on Elaine Byrne's role in the Lowry tapes

    Mr Lowry has also alleged that the DPP, CAB and the Revenue Commissioners were "profoundly misled" by a number of parties including Sunday Independent journalist Dr Elaine Byrne and its editor Anne Harris.Mr Treacy, for Mr Lowry, told Judge Thomas Teehan that Ms Byrne met with the Criminal Assets Bureau at the offices of the Sunday Independent on February 22nd, 2013 and again on February 23rd 2013 at the bureau's Harcourt Street Dublin Headquarters.
    Mr Treacy said that Ms Byrne did not, however, disclose to the CAB a letter from Kevin Phelan to Ms Harris dated February 2nd, 2013 or an email sent on February 12th, 2013 from Mr Phelan to Ms Byrne in which he (Phelan) said he could not stand over a purported tape recording of Mr Lowry.
    It was claimed that Ms Byrne did not inform the CAB that Pavilion Capital, a British private equity firm described by Mr Treacy as "an overlord" by Mr Treacy was "controlling information" published in the Sunday Independent.
    None of the parties against whom Mr Lowry has made allegations are represented in court as it was disclosed by him as part of his efforts to cease the prosecution against him.
    Mr Treacy said the purported tape recording, "which the while country knows about" can not be relied on by the prosecution because Mr Phelan will not co-operate with the prosecution against Mr Lowry .
    "It is completely unstatable that that tape recording will be played in this case," said Mr Treacy who says there is an insufficiency of evidence.
    "The tape is gone," said Mr Treacy.

    Judge Tom Teehan will give a decision on whether the case can proceed on 5 December. The prosecuting oounsel has said the Lowry tapes will not be used in evidence but that certain newspaper article are of public interest and could be used.

    The 60-year-old independent TD from Holycross now faces five charges, including knowingly completing incorrect tax returns on a number of dates between 2003 and 2007.
    The judge rejected the defence arguments".


    Fair play to the Judge, he withstood the pressures and moved Lowry closer to a guilty verdict.

    A Jury will surely deliver a hard but fair verdict on the teflon Lowry, ensuring he gets kicked out of politics and those around him.

    Former Fine Gael minister Michael Lowry is seeking permission to bring a High Courtchallenge aimed at preventing his trial on alleged tax offences. This prosecution is “extraordinary” because it concerns a payment to the Independent TD had both declared and paid, his counsel Patrick Treacy SC said.
    Mr Lowry (60), Glenreigh, Holycross, Co Tipperary, argues he has no outstanding tax liability and is being treated unfairly and selectively in circumstances where it has not been sought to prosecute others, including some 145 holders of Ansbacher accounts said to have a liabilit

If Mr Lowry was a “hopeless” politician who could not get elected, he would get a trial in his own constituency but, because he is successful, he does not, counsel said.
    The DPP had not objected to another Independent Tipperary TD, Mattie McGrath, being tried in Tipperary (on various public order offences of which he was acquitted), counsel said.

    My God! Did his barrister actually stand up in a court and claim this?! It might be the most outlandish legal argument put forward in the history of the country.

    Will we now see Dublin criminals arguing that they are being unfairly pursued by Culchee policemen?

    Interesting decision by the Revenue Appeals Commissioners:

    Independent TD Michael Lowry has confirmed he will be seeking a High Court judicial review to have proceedings brought against him by the Director of Public Prosecutions and the Revenue Commissioners struck out.The statement comes after the Tax Appeals Commissioners found Mr Lowry has no tax liability.
    The case against the 60-year-old alleged he had filed incorrect tax returns in 2003 and 2007.
    In a statement, Mr Lowry, of Glenreigh, Holycross, Co Tipperary, said the Tax Appeal Commissioners have unanimously ruled that he had no tax liability and his tax returns were correct.
    The statement adds that his company Garuda, trading as Streamline Enterprises, was also successful in its appeal against a Revenue assessment for PAYE and PRSI.
    Mr Lowry said "further to the Appeal Commissioners decisive, clear cut rejection of Revenue's position, my legal team will now be asking the Courts to dismiss the Prosecution against me."

    Apparently Elaine Byrne was interviewed by Gardai last night in connection with a a complaint from Lowry in relation to the leaking of info about his house being raided by Revenue. She reckons that other journalists will also be questioned as part of the same investigation.

    Elaine Byrne has plummeted in my estimation after writing a thoroughly heartless and reactionary opinion piece opposing all rent regulation and, in effect, supporting a return to McCreevyite housing bubble policies as the answer to the homeless crisis.

    Lowry is no angel, but I no longer set much store by Byrne.

    Seems like she's a neo-liberal free marketeer in terms of her personal politics.

    But tbh, I don't think that should signify in relation to backing her in campaigning against corruption.
